General Terms and Conditions

1. Applicability

These terms and conditions apply to all offers, agreements and services of KIYAYA, including our (digital) plugins and physical products such as NFC products.

2. Use of services and licenses

• All plugins are provided under license. You are granted a non-exclusive, non-transferable right to use the plugin in accordance with the license terms.
• Plugins have a 14-day return period. NFC products are excluded from this return policy.
• If you request a refund within 14 days, the license for the plugin in question will be blocked after the refund. This makes sense: you'll receive your money back, but the right to use it will expire.

3. Order, payment and delivery

• Digital products (plugins) are made available via license activation or download after successful payment.
• Any applicable taxes and surcharges will be listed separately during checkout. In principle, you don't pay VAT, as KIYAYA falls under the KOR scheme.

4. Right of withdrawal and refunds

• Plugins: 14-day money-back guarantee.
• NFC products: excluded from returns, unless mandatory law provides otherwise (for example, in the event of a defect in accordance with the law).
• If the refund is approved, the plugin license will be terminated and technically blocked.

5. Compatibility and Support

KIYAYA is not responsible for misuse of our products. We cannot test all WordPress themes for compatibility with our plugins. If our plugin doesn't work, we will assist you with installation where possible. If it truly doesn't work, you are, of course, entitled to a refund within our 14-day money-back guarantee.

6. Intellectual property

All content, code, designs, and branding on the website and in the plugins are the property of KIYAYA or its licensors, unless otherwise stated. No part of these materials may be copied, distributed, or published without prior written permission.

7. Liability

To the extent legally permitted, KIYAYA is not liable for damages resulting from improper use, incompatibility with specific WordPress themes, or other circumstances beyond our reasonable control. This does not affect your statutory rights, including your 14-day right of withdrawal for plugins.

8. Changes

We may update these terms from time to time. The most recent version is always authoritative and replaces previous versions. We will notify you of any material changes via our website or during the purchase process.

9. Applicable law

These terms and conditions are governed by Dutch law.
